আজ তনুর ফরেনসিক মেডিসিনের মৌখিক পরীক্ষা। তনু বলতে গেলে ভালোই নার্ভাস কারণ পরীক্ষা শুরু তাকে দিয়েই।
পাঁচ মিনিট পর তার ডাক আসল। তনু ভয়ে ভয়ে স্যারকে সালাম দিয়ে রুমে ঢুকল।
স্যার: কী ব্যাপার মেয়ে, ভয় পাচ্ছ কেন? সব তো পড়েছ তুমি। নাও একটা কার্ড তুলে আমাকে দাও।
তনু স্যারের টেবিলের উপর পরে থাকা কার্ডগুলো থেকে একটি তুলল। কার্ডটি উল্টে দেখে তার প্রশ্ন হলো Definition of rape. তনু মনে মনে খুশি হয়ে গেল কারন এই টপিকটি সে অনেক ভালো করে পড়েছে এবং কার্ডটি স্যারকে দিল।
স্যার: আচ্ছা, তাহলে বল definition of rape কী?
তনু: According to sec.375, BPC, ‘A man is said to commit rape if he has sexual intercourse with a woman under circumstances falling in any of the 5 following descriptions-
- Against her will
- Without her consent
- With her consent, when her consent has been obtained by putting her or any person in whom she is interested, in fear of death or of hurt
- With her consent, when the man knows that he is not her husband, and her consent is given because she believes that he is another man to whom she is or believes herself to be lawfully married
- With or without her consent, when she is under 16 years of age.
স্যার: Very good. সুন্দর করে বলেছ। আচ্ছা তাহলে এখন বলতো এই definition এ will এবং consent বলতে কী বুঝায়?
তনু: will হচ্ছে ইচ্ছা এবং consent হচ্ছে মতামত।
স্যার: তাহলে sexual intercourse with an unconscious woman এর ক্ষেত্রে কী বলবে?
তনু: স্যার তখন আমরা বলব sexual intercourse done without her consent, কারণ unconsciously কেউ ইচ্ছা প্রকাশ করতে পারে না।
স্যার: এবার বল constitution of rape কী?
তনু: It is the slightest penetration of the penis within the vulva i.e. between the labia with or without emission of semen or rupture of hymen.
স্যার: good. তোমাকে আরেকটি important প্রশ্ন ধরি। বলতো what are the pre-requisites of rape victim examination?
তনু: The prerequisites are-
- A requisition for examination of the victim from an authorised person
- Identification of the victim by an authorised person before the medical officer
- Informed written consent
- 3 passport size photographs
- Presence of an adult, mentally sound female attendant.
স্যার: Good. ৩টি ছবি কোথায় কোথায় লাগে বলতো।
তনু: ১টি ছবি requisition form এ,
আরেকটি X-ray report এ,
এবং আরেকটি pathology department এ।
স্যার: এখন বল আমরা rape victim examination এ কী কী specimen collect করব?
তনু:
- Wearing dress with undergarments
- Vaginal swab and cervical smear
- Foreign pubic hair
- Matted pubic hair
- Victim’s own pubic hair
- Swab from teeth bite marks
- Scrapping from suspected stain mark from body surface
- Scrapping from nail beds for blood and cuticle of the accused
- Blood and urine
স্যার: Good. এখন বলতো Marks of violence এবং signs of struggle গুলো কী কী?
তনু: Marks of violence:
- Bite mark over the lips, face, breast, labia etc
- Bruises and abrasions etc
Signs Of struggle:
- Bruises on the posterior medial aspect of the forearm
- Bruises and abrasions on the upper limbs, thighs, genitals etc
- Fingernails may be broken
- Nail beads may contain blood or cuticle of the accused etc
স্যার: হুম, এবার বলতো Rape এর complications কী?
তনু: Complications are:
- Rape may be followed by murder
- Death may occur due to suffocation
- Vaginal stricture or recto-vaginal fistula
- STDs
- Pregnancy due to rape
- Rape-trauma syndrome
স্যার: Rape-trauma syndrome কী পারবে বলতে?
তনু: It consists of those behavioural, somatic and psychological reactions that occur as a result of forcible rape or attempted forcible rape.
স্যার: আরেকটু বুঝিয়ে বল।
তনু: স্যার, উমম, যদি কোনো মেয়েকে জোর করে ধর্ষণ বা তার চেষ্টা করা হলে, ঐ victim মেয়েটির মধ্যে যে আচরণমূলক এবং মানসিক যে পরিবর্তনগুলো ঘটে তাকেই একসাথে বলা হয় Rape-trauma syndrome.
স্যার: এবার তাহলে stages গুলো বলে ফেল।
তনু:
- Phase of disorganization: প্রাথমিক ভাবে মেয়েটির মধ্যে যে change গুলো কাজ করে-
• Emotional imbalance
• Depression
• Feeling of guilt
2. Phase of reorganisation: মেয়েটিকে আস্তে আস্তে counselling করার পর মেয়েটি যখন নিজেকে আস্তে আস্তে গোছানো চেষ্টা করে তখন এটাকে phase of reorganisation বলে। এটির characteristics হলো:
• Gradual adjustment with occasional phobia and fear state
• She may suffer from nightmares and various phobias.
স্যার: Very good. তোমাকে অনেক কিছুই ধরলাম, সবই পাড়লে, তাহলে তোমাকে আরেকটি শেষ প্রশ্ন ধরি। এটা পাড়লে তোমাকে সর্বোচ্চ নম্বর দিব। বলতো can a woman commit rape?
তনু: না স্যার।
স্যার: তাহলে এরকম case এ আমরা এটাকে কী বলব?
তনু: indecent assault
স্যার: (হেসে ড্রয়ার থেকে চকলেট বের করে তনুর হাতে দিয়ে বলল) অনেক প্রশ্ন করেছি তোমাকে, এবার যাও। তোমার পরের জনকে পাঠিয়ে দাও।
